Terms and Conditions - GESTION QWIK INC
1. Acceptance of Terms
Welcome to the GESTION QWIK INC application (“App”). By using or accessing the App, you accept these Terms and Conditions (“Terms”) as legally binding. If you disagree with any part of these Terms, please stop using the App immediately.
GESTION QWIK INC (“QWIK”, “We”, “Us”) operates the App. Users include pharmacy owners, pharmacists, and technicians (“You” or “User”).
2. Purpose of the App
QWIK is a platform connecting pharmacy owners with qualified pharmacists and technicians. The App allows users to view, apply, and accept temporary pharmacy contracts. QWIK facilitates communication and payments but does not employ or place users. Users remain independent contractors responsible for fulfilling their contracts.
3. Payment Structure
Pharmacy owners pay QWIK for services rendered by users.
QWIK pays users for completed contracts based on agreed rates.
QWIK acts only as an intermediary for payments, not an employer.
Users are responsible for the execution and quality of their work.
QWIK will issue Relevé 1 (for Quebec) and T4A (for Canada) to users for income reporting purposes.
Disputes related to service quality or professional conduct are between the user and the pharmacy owner, with QWIK assisting only in mediation if needed.
4. Account Registration
Each user may create one account only.
Users must provide accurate, current, and complete information, including professional licenses.
Users are responsible for keeping their credentials secure and for all activities under their account.
Immediately report to QWIK if you suspect unauthorized access.
5. Contracts and Penalties
Users must honor accepted contracts.
Cancellation without valid reason or proof may result in penalty fees:
Pharmacists: 20% of contract value
Technicians: 50% of contract value
QWIK may find replacements to avoid penalties.
6. Content Guidelines
Users may submit profile information, images, or documents. By submitting, they grant QWIK a non-exclusive, perpetual license to use, display, and distribute the content.
Content must not violate laws or infringe rights (copyright, privacy, trademarks).
Inappropriate content (offensive, vulgar, defamatory, illegal) may be removed.
7. Platform Rules and Code of Conduct
Users must have valid professional licenses.
Minimum age: 14 years.
All communication must be professional and respectful.
Prohibited actions: spam, harassment, publishing sensitive info, impersonation, illegal activities, hate speech, and sharing accounts.
QWIK may suspend or terminate accounts for violations.
8. Limitation of Liability
QWIK provides the App “as is” and does not guarantee work outcomes.
QWIK is not liable for disputes between users and pharmacy owners or for indirect damages.
Liability is limited to the amount paid by the pharmacy owner to QWIK for the relevant service.
9. Dispute Resolution
Users should first contact QWIK for internal resolution.
Disputes are governed by Canadian law.
